Terms of Service
Last updated: October 2026
These terms apply to every quote, agreement and project between KHOMA (Amsterdam, the Netherlands; Chamber of Commerce no. 9831672) and you, the client. By accepting a quote you agree to these terms.
1. Quotes and agreements
Our quotes are valid for 30 days. An agreement starts once you accept a quote in writing, by email included. Work that falls outside the agreed scope is quoted separately before we start on it.
2. Planning and cancellation
Shoot dates are reserved once the agreement is confirmed. If you cancel or move a shoot less than 7 days before the date, we may charge 50% of the fee for that day. Less than 48 hours before, we may charge the full day fee. Costs we have already made, such as crew, travel or rentals, are always charged.
3. Your responsibilities
You make sure we have access to locations and people at the agreed time, and that you have the permissions needed to film there. You are responsible for the materials you give us, such as logos, music, text or footage, and confirm that you have the right to use them.
4. Revisions and delivery
Each project includes two rounds of revisions on the edit unless agreed otherwise. Further changes are charged at our hourly rate. Delivery dates are estimates; we let you know as early as possible if a date moves. Raw footage is not included unless it is part of the agreement.
5. Payment
Payment terms, including any deposit or instalments, depend on the project and are set out in the quote. Invoices are due within 14 days. If payment is late we may pause work and charge statutory interest and collection costs as allowed under Dutch law.
6. Usage rights
Once all invoices are paid, you receive a licence to use the delivered work for the purposes and channels agreed in the quote. KHOMA keeps the copyright. We may show the work in our portfolio and on our own channels unless we agree otherwise in writing.
7. Liability
We do our best to deliver the work as agreed. Our liability is limited to the amount invoiced for the project concerned and never covers indirect damage such as lost revenue. We are not liable when delays or damage are caused by events outside our control, such as illness, extreme weather or equipment failure, and we will propose a new date in those cases.
8. Applicable law
Dutch law applies to these terms and to every agreement with KHOMA. Disputes go to the competent court in Amsterdam. Questions about these terms can be sent to info@khoma.nl.
